These Terms of Service (“Terms”) govern your use of the website at chemistryengine.app and any application published by Chemistry Engine LLC (“Chemistry Engine,” “we,” “us,” or “our”), together the “Services.” By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old to use the Services, and old enough to form a binding contract where you live. Some applications are restricted to users aged 18 or older; those restrictions are stated on the application's store listing and inside the application itself, and you agree to comply with them.
2. License
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use our applications on devices you own or control, for your own non-commercial use. We reserve all rights not expressly granted.
3. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to derive the source code of the Services, except to the extent this restriction is prohibited by law
- Interfere with, disrupt, or place unreasonable load on the Services or their infrastructure
- Use the Services to break the law, infringe anyone's rights, or harass, abuse, or harm another person
- Access the Services through automated means in a way that circumvents intended limits, or resell or redistribute access
- Remove, obscure, or alter any proprietary notices
4. Your content
You retain ownership of any content you create or submit through the Services. You grant us a limited license to host, store, and process that content solely as needed to operate the Services and provide them to you. You are responsible for the content you submit and for having the rights to submit it.
5. Intellectual property
The Services, including their software, design, text, graphics, and the Chemistry Engine name and logo, are owned by Chemistry Engine LLC or its licensors and are protected by intellectual property laws. These Terms do not transfer any ownership to you.
6. Purchases
Paid features and in-app purchases are sold and processed by the platform operator through which you obtained the application, such as the Apple App Store or Google Play. Pricing, billing, refunds, and subscription management are governed by that platform's terms. Refund requests should be directed to the platform; we can assist but cannot process platform refunds ourselves.
7. Third-party platforms
If you obtained an application through the Apple App Store, you acknowledge that these Terms are between you and Chemistry Engine LLC only, not with Apple, and that Apple has no responsibility for the application or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Equivalent terms apply to Google and any other distribution platform.
8. Availability and changes
We may modify, suspend, or discontinue any part of the Services at any time. We aim to give reasonable notice of significant changes but are not obligated to maintain any particular feature. The Services may be unavailable from time to time for maintenance or reasons outside our control.
9. Termination
You may stop using the Services at any time by deleting the application. We may suspend or terminate your access if you materially breach these Terms or if required by law. Sections that by their nature should survive termination will survive.
10. Disclaimer of warranties
The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
11. Limitation of liability
To the maximum extent permitted by law, Chemistry Engine LLC and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to your use of the Services. Our total aggregate liability for all claims relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or fifty United States dollars.
12. Indemnification
You agree to indemnify and hold harmless Chemistry Engine LLC from any claims, damages, liabilities, and reasonable legal fees arising out of your misuse of the Services or your violation of these Terms or applicable law.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. The exclusive venue for any dispute not subject to small claims court will be the state or federal courts located in California, and you consent to their jurisdiction. Nothing in this section limits any non-waivable right you have under the law of your own country of residence.
14. Changes to these Terms
We may revise these Terms from time to time. When we do, we will update the “Last updated” date above. Continuing to use the Services after a change takes effect means you accept the revised Terms.
